Canela Media, Inc. (“Canela,” we,” or “us”) values your privacy.  In this Privacy Policy (“Policy”), we describe how we collect, use, disclose and otherwise process the personal information described below, as well as the rights and choices you have regarding such personal information.

    1. CCPA Privacy Notice for California Residents

1. Scope

This Privacy Policy applies to our collection, use, and disclosure of personal information related to the “Services,” which includes:  

  • The Canela TV streaming services and content, which are available online, via Canela mobile apps, and through certain third-party platforms and streaming services, including www.canela.tv, the Canela TV mobile apps, and other any applications and channels that we make available through third-party platforms (e.g., Roku) and streaming services (collectively, “Canela TV);
  • Our websites (each a “Site”), including www.canelamedia.com and www.canela.tv, on which this Policy is posted;
  • Our marketing, advertising and promotional activities, such as email marketing campaigns, online advertising, and contests and other promotions, as well as any surveys, market research and analytics that we conduct; and
  • Customer support, troubleshooting and other interactions with current, former and prospective users of our Services.

This Policy also does not apply to any third-party platforms, streaming services, websites, or online services maintained by other companies, which are linked to from our Site or other Services or through which Canela TV or the Services are available.

Your use of our Services, and any dispute over privacy, is subject to this Policy and our Terms of Use , including its applicable limitations on damages and the resolution of disputes. Our Terms of Use are incorporated by reference into this Policy.

2. Personal Information Collection

We collect information directly from you, from third parties (such as social networks, streaming media device providers, and operators of certain third-party services that we use), and by automated means as set out below.

A. Personal Information Collected Directly.

The personal information we collect from you depends upon how you use our Services or otherwise interact or engage with us, but generally includes:

  • Registration and profile information. You can access and watch Canela TV and use most of our Services without registering or creating an account.  However, users have the option to create an account and profile, so that they can save favorites, history and preferences across platforms and devices.   If you register for an account with us, we collect certain personal information from you, including your name, username, email address, preferred language, as well as any personal information you post to your profile or account, such as address and other contact information, preferences and settings.
  • Communications and interactions.  When you communicate or interact with us, whether through the Site, via email or otherwise, we collect and maintain a record of your contact details (if you provide them), communications and our responses. For example, we maintain records of communications and information that you post in other areas of the Services, as well as on our social media channels, and information you provide to us related to any customer service or support requests.  
  • Promotions and surveys . If you participate in sweepstakes, contests, and promotions that we offer, we might collect your name, age, email address, and other registration information that you provide us and related to contests, sweepstakes, and promotions. We may also conduct surveys, which may help us evaluate, develop and improve our Services and better respond to audience preferences.  If you respond to surveys or similar requests, we will collect whatever personal information, including name and contact information and survey responses that you provide us.
  • Events and other requests. For example, if you register for or attend an event that we host or sponsor, we may collect information related to your registration for and participation in such event.  When you fill out a ‘Contact Us’ form, signup for our mailing lists, or otherwise request information from us, we collect and maintain records of your requests.

B. Personal Information from Third Parties Sources.

We collect information about you from other sources, such as public sources, business partners, advertisers and third-party platforms. For example, we may collect information from the following sources:

  • Platform operators that distribute or make available Canela TV.  If you access Canela TV or Canela TV apps or otherwise use the Services through third-party platforms or devices, such app stores (e.g., iOS and Android), streaming services, streaming devices (e.g., Roku), cable and internet providers, smart TVs and other platforms (e.g., Apple TV+), (collectively, “Platform Operators”), we may receive data about you and your device from the relevant Platform Operator, including your country/location, user ID, other identifiers, and device information.
  • Vendors and service providers. We outsource some of our operations to our service providers and vendors and use certain third-party platforms to operate our Services.  They may collect and provide us with IP address, unique identifiers, and other user activity information.   
  • Data providers, ad networks and other advertising partners. We may receive IP addresses, device IDs, other unique identifiers, and information about you, such as information about your online activities, interests, household information, and demographics.
  • Third-party advertisers and ad services.  We also work with third-party advertisers that show ads through Canela TV. The advertisers and ad services may also provide data about individuals to us to help us personalize and measure ads through the Services, and as described further below.
  • Social media and other third-party platforms. If you post information about us or engage with us on social media or other third-party platforms or choose to link your account to or log in to our Services with a third-party account (e.g., Google), we may collect personal information about you from that third-party platform. These third-party platforms and services control the information they collect and share about you.  For information about how they may use and disclose your information, including any information you make public, please consult their respective privacy policies.

C. Personal Information We Collect Automatically or Derive

We automatically collect personal information related to your use of our Services and interactions with us and others, including information we collect automatically (e.g., using cookies and pixel tags).  We may also derive information about you (e.g., your preferences, interests and demographic information) and your use of the Services. Such information includes:

  • Device and browsing information. We use cookies, third-party SDKs, pixel tags, and other tracking technologies to automatically collect personal information when users access Canela TV or user our Site and other Services.  This information may include IP address and other unique identifiers, general location information (and in some instances, device geolocation information), browser type, domain names, access times, pages views, date/time stamps, operating system, language, mouse clicks, mouse movements, scrolling activity, device type (e.g., network devices, your computer, or other Canela capable devices you might use to access our Services), unique ID, Internet service provider, referring and exiting URLs, and similar device and usage information. For more information about our use of cookies and other online tracking tools, please see the “Cookies, Targeting, and Analytics” section below.
  • Activities and usage. We collect activity information related to your use of our Services, such as information about the links clicked, searches, features used, pages viewed, time spent, and files uploaded. We also collect activity information related to your use of our Services, such as title selections, shows you have watched, ads viewed (if applicable), and search queries. We may use analytics providers and technologies, including cookies and similar tools, to collect this information. Please note that we do not share user viewing history with third parties, without authorization from users.

3. Purposes of Collection and Use

Generally, we collect, use, disclose and otherwise process information, including personal information, for the following purposes:

  • Providing services and support. For example, to provide and maintain our Services, optimize streaming and availability of content, to meet platform-related requirements set by Platform Operators, to improve our Services, to perform technical operations, and for other maintenance, service and support purposes.
  • Communicating with you about the Services. For example, to send notices, updates, security alerts and other administrative messages, and to respond to your comments and requests. We may also send user surveys and questionnaires, such as for market research or customer satisfaction purposes.
  • Analytics and improvement. To better understand how users access and use our Services, and for other research and analytical purposes, such as to evaluate and improve our Services and operations and to develop additional products, Services and features, and for internal quality control and training purposes.
  • Personalization. To personalize the information and content we display to users, including to make content recommendations, and to better understand user preferences and interests in order to enable us to personalize content and ads within the Services.
  • Our advertising services. To show you ads (including personalized ads) through the Services and on third-party websites, mobile apps, platforms and devices, as well as to measure and understand the reach and effectiveness of these ads and provide analytics and reporting to advertisers and ad partners. We also help advertisers and ad partners reach their target audiences and measure and improve their ad campaigns. In order to do this, we may associate browsers and devices (such as smart TVs, streaming devices, smartphones and mobile devices and other devices) used by the same individual or household, in order to better reach them with targeted ads on different browsers or devices and limit the number of times they receive the same ad.  
  • Marketing and promotions.  For marketing and promotional purposes, including to send you news, updates, alerts and promotional information by email and text about the Services or products, services and offers from Canela and our partners that may interest you, as well as to evaluate, measure and improve our marketing.  
  • General business and operational support. To consider and implement mergers, acquisitions, reorganizations, bankruptcies, and other business transactions, and related to the administration of our general business, accounting, auditing, compliance, recordkeeping, and legal functions.
  • Security and protection of rights. To protect the Services and our business operations, including to prevent and detect fraud, misuse and unauthorized activities, as well as where we believe necessary to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety or legal rights of any person or third party, or violations of our Terms of Use or this Policy.
  • Complying with legal obligations. To comply with the law and our legal obligations. For example, we may record, retain and disclose information in response to subpoenas, court orders, and other lawful requests by regulators and law enforcement.

4. Disclosure of Information

We may disclose the information, including personal information, that we collect to others, as reasonably necessary for the purposes described above and as otherwise directed or authorized to by you, which may include:

  • Vendors and service providers. To vendors, service providers, contractors, or agents who process such information on our behalf, in order to provide services to us or perform functions on our behalf, including IT service providers, content delivery networks, analytics providers, and data providers that that we work with to enhance our data.
  • Affiliates and subsidiaries. To our affiliates or subsidiaries; however, if we do so, their use and disclosure of your personal information will be subject to this Policy.
  • Platform Operators. If you access Canela TV or our Services through third-party platforms, websites and other devices, we may disclose certain information to them, including information activity and usage data, IP address, device identifier, preferences and privacy settings, in order to coordinate on the provision of the Services to you, tailor your user experience, and personalize ads to you.  Depending on what Platform Operator services you use, we may also share information so that content and features available in our Services can be suggested to you in the Platform Operator’s user interface.
  • Advertisers, ad networks and ad partners.  To advertisers, ad networks and other advertising partners (“ad companies”), as well as Platform Operators, that we work with show you ads that may interest you—including ads about Canela’s and third-party products and services—within the Services and on other websites, apps, and devices. We may disclose information to these ad companies and Platform Operators, and, in some cases, they may set and access their own cookies, pixel tags and similar technologies on the Services and otherwise collect or have access to information about you which they collect over time and across different online services and devices.
  • Ad measurement providers. To advertising measurement providers and other service providers that help us and ad companies understand information about the content and ads viewed, and the effectiveness of ad campaigns, including the audience that saw the ads and how they responded. These measurement providers collect or receive information about your viewing of or interaction with content and ads within the Services and through our advertising services on other websites, mobile apps, and platforms. Measurement providers use your information to create metrics about what content and ads are being watched, in order to understand the audience and to measure the effectiveness of the ads.
  • Protecting rights and interests . To law enforcement and others where we believe doing so is necessary to protect the Services, our rights and property, or the rights, property and safety of others.  For example, in order to (i) prevent, detect, investigate and respond to fraud, unauthorized activities and access, illegal activities, and misuse of the Services, (ii) situations involving potential threats to the health, safety or legal rights of any person or third party, or (iii) enforce, and detect, investigate and respond to violations of, our Terms of Use . We may also disclose personal information, related to litigation and other legal claims or proceedings in which we are involved, as well as for our internal accounting, auditing, compliance, recordkeeping, and legal functions.
  • Legal compliance. To regulators, law enforcement and other third parties in order to comply with applicable legal or regulatory obligations, including as part of a judicial proceeding, in response to a subpoena, warrant, court order or other legal process, or as part of an investigation or request, whether formal or informal, from law enforcement or a government official.
  • Business transfers. We may disclose your information to another entity in connection with an acquisition or merger, sale or transfer of a business unit or assets, bankruptcy proceeding, or as part of any other similar business transfer, including during negotiations related to such transactions.

5. Aggregate and Non-identifiable Information

We may collect, use, disclose, and otherwise process aggregate and de-identified information for marketing, advertising, research, compliance, or other purposes. Where we use, disclose or process data that has been de-identified data we will maintain and use the information in de-identified form and not to attempt to reidentify the information, except pursuant to applicable privacy laws.

6. Cookies, Targeting, and Analytics

We and our third-party service providers use cookies, pixels, java script, and other mechanisms to automatically collect information browsing, activity, device and similar information within our Services. We use this information to, for example, analyze and understand how users access and use the Services, how they interact with others through our Services, as well to identify and resolve bugs and errors in our Services and to assess secure, protect, optimize and improve the performance of our Services.

Cookies.  Cookies are alphanumeric identifiers that we transfer to your device’s hard drive through the Services for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our Services, while others allow us to track your activities in our Services, support the security and performance of the Services, or allow us to track activity and usage data within Service.  Most web browsers automatically accept cookies, but if you prefer, you can edit your browser options to block them in the future. The Help portion of the toolbar on most browsers will tell you how to prevent your computer from accepting new cookies, how to have the browser notify you when you receive a new cookie or how to disable cookies altogether.

Pixel Tags. Pixel tags (sometime called web beacons or clear GIFs) are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your device, pixel tags are embedded invisibly on web pages and online content. We may use these, in connection with our Services to, among other things, track the activities of Site visitors, help us manage content, and compile statistics about Site usage. We and our third-party service providers also use clear GIFs in HTML emails to our customers, to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded.

Third-Party Analytics. We may use non-affiliated analytics companies, for example Google Analytics (see privacy policy and opt-out), to evaluate use of our Services. We use these tools to help us understand use of, and to improve, our Services, performance, ad campaigns, and user experiences. These entities may use cookies and other tracking technologies, such as web beacons or local storage objects (LSOs), to perform their services. 

Do-Not-Track. Currently, our systems do not recognize browser “do-not-track” requests. You may, however, disable certain tracking as discussed in this section (e.g., by disabling cookies); you also may opt out of targeted advertising by following the instructions in the “Cookies, Targeting, and Analytics” section.

Advertising and Targeting. As described above, we work with third parties, such as third-party ad networks, channel partners, analytics and measurement services and other third-party ad companies to personalize content and display advertising within our Services, as well as to manage our advertising on third-party sites and online services. We and these third-party ad companies may use cookies, pixels tags, and other tools (which we may refer to collectively as “targeting cookies”) to collect activity information within our Services (as well as on third-party sites and services), as well as IP address, location information, unique ID, cookie and advertising IDs, and other identifiers, as well as browsing information. We and these third-party ad companies use this information to provide you more relevant ads and content within our Services and other online services and on third-party sites and apps, and to evaluate the success of such ads and content. 

Preferences. We make available several ways for you to manage your preferences regarding third-party advertising and cookies within our Site and Services. Many of these are browser and device specific, which means that you need to set the preference for each browser and device you use to access our Site and Services. In addition, if you delete or block cookies, you may need to reapply these preferences.  Further, opting out of cookies and advertising as discussed below does not mean that you will no longer receive advertising content from us. You may continue to receive generic or “contextual” ads from us.  

  • Browser settings. To prevent cookies from tracking your activity on our Site or visits across multiple websites, you can set your browser to block certain cookies, notify you when a cookie is set or delete cookies. Visitors to our Site and other online services who disable cookies will be able to browse the Site, but some features may not function.
  • Mobile apps. Our apps may include third-party advertising and personalization. You can opt out of targeted advertising in our mobile app through the in-app settings by adjusting your device privacy settings (please refer to your device settings for more information). This means that you will no longer get targeted ads in the app; however, you may still receive contextual or general ads.
  • Industry ad choice programs. You can control how participating third-party ad companies use the information that they collect about your visits to our Sites and those of third parties, in order to display more relevant targeted advertising to you. For more information and to opt out of receiving targeted ads from participating third-party ad networks go to aboutads.info/choices (Digital Advertising Alliance). You can also download the DAA AppChoices tool in order to help control interest-based advertising on apps on your mobile device.

    Please note that opting out of participating ad networks does not opt you out of being served advertising. You may continue to receive generic or contextual ads on our Services. You may also continue to receive targeted ads on other websites, from companies that do not participate in the above programs.

  • Custom lists and matching. Subject to applicable law, we may share certain customer list information (such as your email address or other contact information, which in most cases is hashed when it is shared) with third parties so that we can better target ads and content to our Users, and others with similar interests, within their services and other third-party platforms and services. These third parties use the personal information we provide to help us target ads and to enforce their terms, but we do not permit them to use or share the data we submit to target ads for third parties. You may opt out of this as set forth in Section 7. Your Privacy Choices.

7. Your Privacy Choices

Users have several choices regarding their personal information and privacy preferences, as described in this section. Residents of certain jurisdictions have additional rights, as set forth below, in Section 13. Additional Information for Residents of Certain States. Further, if you are a California resident, please review Section 13.A CCPA Privacy Notice for California Residents below, for specific information about your California Privacy Rights and how to exercise them.

Marketing Communications. We may send periodic promotional emails to you. You may opt out of such communications by following the opt-out instructions contained in the email or click here to submit a request. Please note that it may take up to ten (10) business days for us to process opt out requests. If you opt out of receiving promotional emails about recommendations or other information we think may interest you, we may still send you emails about your account or any Services you have requested or received from us. 

Cookie and Targeted Advertising. As described in the “Cookies, Targeting, and Analytics” section above, you can manage your preferences for cookies (including targeting cookies) on our Site and Services by adjusting your cookie settings or other preferences.

Custom Lists and Matching. If you would like to opt out of receiving targeted marketing and advertising from us as part of a custom list (as described in “Advertising and Targeting”), please click here to submit a request.

Mobile Device Settings. In some of our mobile Services, we may send push notifications from time-time in order to update you about shows, movies, other media, or promotions that we may be running. With your permission, we may collect your device’s location information.  If you no longer wish to receive these types of communications or share your location data, you may update the Canela TV app settings on your mobile device.

Accessing and Updating Your Account Information. If you register for an account with us, you can access and update certain information we have relating to your account within your account settings. Please note that we may maintain copies of information that you have updated, modified or deleted, as permitted, in our business records and in the normal course of our business operations.

8. Children

Our Services are directed to a general audience. We do not allow minors to register for a Canela TV account or create a children’s profile. Further, we do not engage in targeted advertising within CanelaKids and other children’s content on Canela TV.  Pursuant to the Children's Online Privacy Protection Act (COPPA), within CanelaKids we (or our service providers acting on our behalf) may collect persistent identifiers, but no other “personal information” as defined by COPPA.  In accordance with COPPA, we collect and use these persistent identifiers so that we can provide the Services and requested content and to support our internal operations. We do not serve interest-based advertising in connection with Canela Kids or other users that we no to be under 13, nor do we use this information beyond what is necessary to support our internal operations. If you believe that we have improperly collected personal information from a child under 13, please contact us as set forth in “Contact Us” section, and we will take action as necessary to securely delete such information.

9. Third-Party Sites and Services

Our Services may contain links to third-party websites. Any access to and use of such linked websites is not governed by this Policy, but instead is governed by the privacy policies of those third-party websites. We are not responsible for the information practices of such third-party websites.

10. Security

We have implemented safeguards that are intended to protect the personal information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction.  Please be aware that despite our best efforts, no data security measures can guarantee 100% security. You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared device.

11. Changes to this Policy

This Policy is current as of the Effective Date set forth above. We may change this Policy from time to time, so please be sure to check back periodically. We will post any changes to this Policy on our Site.  If we make any changes to this Policy that materially affect our practices with regard to the personal information we have previously collected from you, we will endeavor to provide you with notice in advance of such change, such as via email or prominent notice on the Site.

13. Additional Information For Residents of Certain States

Residents of certain U.S. states (including Virginia, Colorado, Connecticut, and Utah) may have additional rights under applicable privacy laws, subject to certain limitations. These rights may include:

  • Correction: to correct inaccuracies in their personal information, taking into account the nature and purposes of the processing of the personal information.
  • Deletion: to delete their personal information provided to or obtained by us.
  • Access: to confirm whether we are processing their personal information and to obtain a copy of their personal information in a portable and, to the extent technically feasible, readily usable format.
  • Opt-out: to opt out of certain types of processing, including:
    • to opt out of the “sale” of their personal information.
    • to opt out of targeted advertising by us.
    • to opt out of any processing of personal information for purposes of making decisions that produce legal or similarly significant effects.
  • Appeal: to appeal our denial of your privacy request, which you can do by submitting a request through our webform.

A. CCPA Privacy Notice for California Residents

Below, we provide information, as required under California privacy laws, including the California Consumer Privacy Act and its implementing regulations, each as amended (“CCPA”), which require that we provide California residents certain specific information about how we handle their personal information, whether collected online or offline. This section does not address or apply to our handling of publicly available information made lawfully available by state or federal governments or other personal information that is subject to an exemption under California privacy laws.

Sales and Sharing. California privacy laws define a “sale” as disclosing or making available to a third-party personal information in exchange for monetary or other valuable consideration, and “sharing” includes disclosing or making available personal information to a third party for purposes of cross-context behavioral advertising. While we do not disclose personal information to third parties in exchange for monetary compensation, we may “sell” or “share” (as defined by the CCPA) Identifiers, Customer Records, Commercial Information, and Usage Data to third-party advertising networks, analytics providers, and social networks. We do not sell or share sensitive personal information, nor do we sell or share any personal information about individuals who we know are under sixteen (16) years old.

Purposes for Collecting and Disclosing.  As described above, in general, we collect and otherwise process the above personal information in order to provide our Services to you, respond to your requests, as otherwise directed or consented to by you, and for the following business or commercial purposes:

Retention. We will retain your personal information as long as necessary for purposes for which the personal information was collected and is used by us, as stated in this Policy. However, if you withdraw consent or otherwise object to our collection, use and disclosure of your personal information, you may not be able to use the services. Further, to the extent permitted by applicable law, we will retain and use your personal information as necessary to comply with our legal obligations, resolve disputes, maintain appropriate business records, and enforce our agreements.

California Residents’ Rights. California residents have the right to receive certain information about how their personal information is used and disclosed and to not be discriminated against for exercising their privacy rights under the CCPA.  The CCPA also grants California residents the following rights (subject to certain limitations):

  • Opt-out of sales and sharing. The right to opt-out of our sale and sharing of their personal information.
  • Delete. Subject to certain exceptions, the right to request deletion of their personal information that we have collected about them.
  • Know/access.     • Categories of third parties to whom the residents' personal information has been sold and shared and the specific categories of personal information sold and shared to each category of third party.
  • Correct. The right to request that a business that maintains inaccurate personal information about the resident correct that personal information.

Submitting CCPA Requests to Know, Correct and Delete. California residents may submit a verifiable request to exercise their CCPA rights as set forth below:

When you submit a request to know, to delete or to correct we will take steps to verify your request by matching the information provided by you with the information we have in our records. To verify your request, we will request that you provide us with your name, email and contact details and to confirm your email address. In some cases, we may request additional information in order to verify your request or where necessary to process your request.

Authorized agents may initiate a request on behalf of another individual by contacting us in writing at the contact information set forth above. Authorized agents will be required to provide proof of their authorization and we may also require that the relevant consumer directly verify their identity and the authority of the authorized agent. We will respond to verifiable requests received from California residents as required by law. If we are unable to adequately verify a request, we will notify the requestor.

Requests to Opt-Out of Sales and Sharing. California residents may submit requests to opt out of “sales” and “sharing” (e.g., targeted advertising) of their personal information by:

You may opt out of our sales and sharing of your personal information by submitting a request through our contact page, please click here to submit your request.We will process your request based upon the personal information in our records that is linked or reasonably linkable to the personal information provided in your opt out request.
  • Browser Opt Out. You may also opt out of “sales” and “sharing” by our Site of online data via your browser by declining cookies by using the navigation bar at the bottom of our website www.canela.tv or by turning on “global privacy control”—or GPC— signals for your browser]. If we recognize that your browser is transmitting a GPC signal, we will opt that browser out of “sales” and “sharing” (including via targeting cookies). Your opt out is browser specific and applies to sales and sharing via cookies and similar browser-based tools through our website.   • Rights Under California's Shine-the-Light Law. Under California’s “Shine the Light” law (Cal. Civ. Code § 1798.83), California residents who provide us certain personal information are entitled to request and obtain from us, free of charge, information about the personal information (if any) we have shared with third parties for their own direct marketing use.  Such requests may be made once per calendar year for information about any relevant third-party sharing in the prior calendar year.
